Terms of Use

These Terms of Use ("Terms") govern your use of the CellarVision mobile application ("App") and the CellarVision website at cellarvision.app ("Website"), collectively referred to as the "Service." The Service is operated by CellarVision ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 21 years old (or the legal drinking age in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

2. Account Registration

To use certain features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

3. Subscription & Billing

CellarVision offers a free tier with limited functionality and a paid subscription ("CellarVision Pro") with additional features. Subscriptions are billed monthly or annually through the Apple App Store. Pricing, free trial terms, and renewal policies are displayed at the time of purchase and governed by Apple's terms.

You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service's infrastructure
• Scrape, crawl, or use automated means to access the Service without permission
• Upload malicious content or content that infringes on third-party rights

5. AI-Generated Content

The Service uses artificial intelligence to generate tasting notes, food pairings, drink window estimates, market value estimates, and wine identification. This content is provided for informational purposes only and may not be accurate. We make no guarantees about the accuracy of AI-generated content. You should not rely solely on AI-generated information for purchasing, selling, or consumption decisions.

6. Market Value Estimates

Wine value estimates provided by the Service are approximate and based on publicly available data. They do not constitute appraisals, investment advice, or guarantees of actual market value. We are not responsible for decisions made based on these estimates.

7. User Content

You retain ownership of any content you submit (photos, notes, cellar data). By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you. We will not sell or share your content with third parties except as described in our Privacy Policy.

8. Email Ingestion

When you forward order confirmation emails to our ingestion address, those emails are processed by AI to extract order information. We store the extracted data and a reference to the original email for deduplication. We do not store or share the full email content beyond what is necessary to provide the Service.

9. Intellectual Property

The Service, including its design, code, and content (excluding user content), is owned by CellarVision and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CELLARVISION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Continued use of the Service after changes constitutes acceptance.

13. Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.
